1. Overview

This website is operated by Roll Box, trading as Rollbox (“Rollbox”, “we”, “us” or “our”).

Our online store is hosted by Shopify, which provides the ecommerce platform that allows us to sell our products to you.

These Terms of Service apply to your use of rollbox.com.au, including any associated webpages, content, features and services, and to any purchase you make through our store.

By accessing our website, placing an order or purchasing a product from us, you agree to these Terms of Service and our:

  • Privacy Policy;

  • Shipping Policy; and

  • Refund and Returns Policy.

If you do not agree to these terms, you must not use our website or purchase products through it.

3. Eligibility

By using this website or placing an order, you confirm that:

  • you have the legal capacity to enter into a binding agreement;

  • the information you provide is accurate and complete; and

  • where you are purchasing on behalf of another person or organisation, you have authority to do so.

If you are under 18 years of age, you must use this website and make purchases only with the involvement and permission of a parent or legal guardian.

4. Products

Rollbox products are household tissue-roll dispensers designed to hold and dispense compatible paper rolls.

We make reasonable efforts to display product descriptions, dimensions, colours, materials and photographs accurately. However:

  • colours may appear differently depending on your screen, lighting and display settings;

  • dimensions may be subject to minor manufacturing tolerances;

  • surface finish, layer lines and small cosmetic variations may occur in 3D-printed products;

  • product appearance may vary slightly between production batches; and

  • website images may include styling items that are not included with the product.

Minor variations that do not materially affect the product’s appearance, function or durability will not generally be considered defects.

Unless expressly stated otherwise, paper rolls, tissues, furniture, decorations and other accessories shown in product photographs are not included.

5. Product compatibility and use

You are responsible for checking the product description, dimensions and compatibility information before purchasing.

Rollbox products should only be used:

  • for their intended household purpose;

  • with compatible paper rolls;

  • on a stable and suitable surface;

  • in accordance with any instructions supplied with the product; and

  • away from excessive heat, open flames and other conditions that may damage the product.

Rollbox products are not toys. Keep products, packaging and any small or detachable components away from young children where they may present a choking, entrapment or other safety risk.

Do not deliberately place fingers against or inside any cutting, tearing or dispensing mechanism. Children should use the product only with appropriate adult supervision.

You must stop using a product if it becomes cracked, significantly damaged, unstable or unsafe.

6. Orders

Submitting an order through our website is an offer to purchase the selected products. An order is not accepted until we send you an order confirmation or otherwise confirm that we have accepted and begun processing it.

We reserve the right to accept, reject or cancel an order where reasonably necessary, including where:

  • a product is unavailable;

  • pricing or product information contains an obvious error;

  • we suspect fraud or unauthorised activity;

  • we cannot verify payment or delivery information;

  • an order exceeds available production capacity;

  • delivery to the nominated address is unavailable; or

  • accepting the order would breach a law or regulatory requirement.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled portion of the order.

7. Product availability and production times

Products may be manufactured in small batches or made after an order is placed.

Any production, dispatch or delivery timeframe shown on our website is an estimate only unless we expressly agree otherwise in writing.

We may limit the number of products available for purchase by a customer, household, account, payment method or delivery address.

We may discontinue, modify or replace products at any time. This will not affect orders already accepted unless we contact you and agree to an alternative arrangement.

8. Prices and payment

All prices are displayed in Australian dollars unless stated otherwise.

Prices include Australian GST where GST is applicable. Shipping charges, taxes, duties and other applicable fees will be displayed at checkout or otherwise communicated before your order is confirmed.

You agree to provide current, complete and accurate billing and payment information.

Payment must be successfully authorised before we are required to process or dispatch an order.

We may correct genuine pricing, description or calculation errors. If an error affects an order you have placed, we will contact you and offer you the choice of:

  • proceeding at the corrected price; or

  • cancelling the affected item for a refund.

9. Discount codes and promotions

Discount codes and promotional offers:

  • must be used in accordance with their stated conditions;

  • cannot be exchanged for cash;

  • may be limited to one use per customer or order;

  • cannot be combined unless expressly stated;

  • may exclude selected products; and

  • may be withdrawn or modified before an order is placed.

A promotion will not affect any rights you have under the Australian Consumer Law.

10. Custom and personalised products

Where we offer colour selections, custom combinations, personalised features or made-to-order products, you are responsible for checking your selections carefully before submitting your order.

Once production has commenced, we may be unable to change or cancel a custom order.

We are not required to accept a change-of-mind return for a custom or personalised product. However, this does not limit your rights where the product is faulty, unsafe, materially different from its description or otherwise fails to comply with the Australian Consumer Law.

11. Shipping and delivery

Shipping is governed by our Shipping Policy.

You must provide a complete and accurate delivery address. We are not responsible for delays or additional costs caused by incorrect or incomplete information supplied by you.

Risk in the product passes to you when it is delivered to the address provided in your order, unless applicable law provides otherwise.

Title to the product passes to you once we have received full payment.

Delivery dates are estimates and may be affected by production times, carrier delays, weather, peak periods, customs processing and other events outside our reasonable control.

If your parcel appears lost, damaged or significantly delayed, contact us at admin@rollbox.com.au with your order details.

12. International orders

International customers are responsible for checking whether our products may be lawfully imported into their destination country.

Unless expressly included at checkout, international prices do not include customs duties, import taxes, brokerage charges or local government fees. These charges may be payable by the recipient.

International delivery timeframes may be affected by customs and local delivery services.

Nothing in this section excludes any mandatory rights that apply to an international customer under applicable law.

13. Returns, refunds and consumer guarantees

Our voluntary change-of-mind returns are governed by our Refund and Returns Policy.

Nothing in these Terms of Service excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, including rights under the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law.

Our products come with guarantees that cannot be excluded under the Australian Consumer Law.

Depending on the circumstances, you may be entitled to a repair, replacement, refund, compensation or another remedy where a product:

  • is faulty or unsafe;

  • is not of acceptable quality;

  • does not match its description or sample;

  • is not fit for a disclosed purpose; or

  • otherwise fails to meet an applicable consumer guarantee.

For a major failure, you may be entitled to reject the product and choose a refund or replacement, subject to the Australian Consumer Law.

For a failure that is not major, we may be entitled to provide a remedy within a reasonable period.

To request assistance, contact admin@rollbox.com.au and provide:

  • your order number;

  • a description of the issue; and

  • photographs or other reasonable evidence of the issue, where relevant.

We may ask you to return the product for assessment. Where the product is confirmed to have a failure covered by the Australian Consumer Law, we will meet our obligations regarding reasonable return costs.

14. Change-of-mind returns

We are not legally required to provide a refund or exchange merely because you changed your mind.

Any change-of-mind return we choose to offer will be subject to our Refund and Returns Policy, including applicable return periods, condition requirements and exclusions.

Change-of-mind rights do not replace or limit your rights under the Australian Consumer Law.

15. Care and misuse

You must follow all reasonable product-care and usage instructions.

Subject to applicable law, we are not responsible for damage caused by:

  • misuse, abuse or neglect;

  • modification or attempted repair;

  • use for a purpose for which the product was not designed;

  • exposure to excessive heat, flame, moisture, chemicals or prolonged direct sunlight;

  • incompatible rolls or materials;

  • ordinary wear and tear; or

  • failure to follow supplied instructions.

This section does not exclude liability for a product that did not meet a consumer guarantee when supplied.

16. Website information

We make reasonable efforts to ensure information on our website is accurate and current. However, information may occasionally contain typographical errors, inaccuracies or omissions.

We may update product descriptions, prices, availability and website content at any time, subject to our obligations regarding orders already accepted.

General information on our website is provided for informational purposes and should not be relied upon as professional, technical or safety advice.

17. Third-party services

Our website may rely on or link to third-party services, including Shopify, payment processors, delivery carriers, social media platforms and external websites.

Third-party services may be subject to their own terms and privacy practices.

We do not control and are not responsible for the content, availability, security or practices of independent third-party websites or services, except to the extent responsibility cannot lawfully be excluded.

18. Intellectual property

All intellectual property associated with Rollbox and our website is owned by or licensed to us, including:

  • the Rollbox name and branding;

  • product designs;

  • photographs and videos;

  • website graphics and layouts;

  • text and marketing materials;

  • logos and trade marks;

  • CAD files, drawings and prototypes; and

  • other original content.

You may access and use our website for personal, non-commercial shopping purposes.

You must not, without our prior written permission:

  • reproduce, copy or republish our content;

  • manufacture products based on our designs;

  • reverse engineer or create moulds, scans, CAD models or replicas of our products;

  • use our photographs or videos commercially;

  • remove copyright, trade mark or proprietary notices;

  • sell counterfeit or imitation Rollbox products; or

  • use our branding in a way that suggests an unauthorised association with us.

Nothing in these terms transfers ownership of our intellectual property to you.

19. Reviews, photographs and submissions

Where you submit a product review, photograph, video, comment, suggestion or other material to us, you confirm that:

  • you own the material or have permission to submit it;

  • it does not infringe another person’s rights;

  • it is not unlawful, misleading, defamatory, abusive or obscene; and

  • it does not contain malicious code.

You grant us a non-exclusive, worldwide, royalty-free licence to reproduce, edit, publish and use the submitted material for our business and marketing purposes.

We will not identify you by your full name in marketing materials without permission, except where the identifying information was knowingly included in a public review or public social-media post.

You may contact us to request that we stop using submitted material in future marketing, although we may be unable to withdraw material that has already been printed, published or distributed.

20. Prohibited conduct

You must not use our website:

  • for an unlawful or fraudulent purpose;

  • to infringe intellectual property or privacy rights;

  • to transmit malicious software or harmful code;

  • to scrape, harvest or collect information without permission;

  • to interfere with the website’s security or operation;

  • to impersonate another person;

  • to submit false or misleading information;

  • to make unauthorised purchases; or

  • to engage in conduct that could harm Rollbox, our customers or third parties.

We may restrict or terminate access to our website where we reasonably believe these terms have been breached.

21. Privacy

We collect, hold, use and disclose personal information in accordance with our Privacy Policy and applicable privacy laws.

By submitting personal information through our store, you acknowledge that it may be processed by Shopify, payment providers, delivery services and other service providers involved in fulfilling your order.

22. Security

You are responsible for maintaining the confidentiality of any account credentials associated with our store.

You must notify us promptly if you suspect unauthorised access to your account or payment information.

Although we take reasonable steps to protect our website, we do not guarantee that it will always be uninterrupted, error-free or free from harmful components.

23. Limitation of liability

Nothing in these terms excludes, restricts or modifies any liability, guarantee, right or remedy that cannot lawfully be excluded or limited.

To the maximum extent permitted by law:

  • we are not liable for indirect, incidental, special or consequential loss that was not reasonably foreseeable;

  • we are not liable for loss caused by your misuse of a product or failure to follow instructions; and

  • our liability will be reduced to the extent that your actions or omissions contributed to the loss.

Where the Australian Consumer Law permits us to limit liability for a failure to comply with a consumer guarantee, our liability may be limited, at our option, to the repair or replacement of the product, the supply of an equivalent product, or the cost of obtaining an equivalent remedy.

This clause does not apply where such a limitation would be unlawful.

24. Indemnity

To the extent permitted by law, you agree to compensate us for reasonable loss, damage, liability or expense arising directly from:

  • your unlawful use of our website;

  • your material breach of these terms;

  • your infringement of another person’s intellectual property or other rights; or

  • content you submit to us.

This obligation does not apply to the extent the loss was caused by our negligence, unlawful conduct or breach of these terms.

25. Events outside our control

We are not responsible for a delay or failure to perform an obligation caused by an event outside our reasonable control, including natural disasters, fire, flood, industrial disputes, transport disruption, telecommunications failure, government action, epidemic, material shortage or carrier interruption.

We will take reasonable steps to minimise the effect of the event and resume performance where practicable.

This section does not limit any rights you have under applicable consumer law.

26. Changes to these terms

We may update these Terms of Service from time to time by publishing an updated version on our website.

The terms in effect when we accept your order will generally apply to that purchase.

Your continued use of the website after updated terms are published constitutes acceptance of the updated website-use terms, but changes will not retrospectively remove rights relating to an existing order.

27. Severability

If any provision of these terms is held to be invalid, unlawful or unenforceable, that provision will be read down to the minimum extent necessary or severed.

The remaining provisions will continue in effect.

28. No waiver

A failure or delay by us in exercising a right under these terms does not waive that right.

29. Entire agreement

These Terms of Service, together with the policies referred to in them and the details of your accepted order, constitute the agreement between you and Rollbox regarding your use of the store and purchase.

They replace any earlier discussions or communications concerning the same subject matter, except where a representation cannot lawfully be excluded.

30. Governing law

These terms are governed by the laws of Western Australia and the Commonwealth of Australia.

You and Rollbox submit to the courts of Western Australia and any courts entitled to hear appeals from those courts.

Nothing in this clause prevents you from exercising any right to bring a claim in another jurisdiction where that right cannot legally be excluded.

We will attempt to resolve the matter promptly and in good faith.

Nothing in this section prevents either party from seeking urgent relief or exercising rights available under the Australian Consumer Law or another applicable law.
